A Jurimetric Analysis of the Non-Prosecution Agreement

Abstract

Given the slowness, overload, and limited effectiveness of the traditional criminal model, the Brazilian legal system incorporated mechanisms of negotiated criminal justice, among which the Non-Prosecution Agreement (ANPP) introduced by Law No. 13,964/2019 stands out. This article aims to analyze the effectiveness of the procedure and identify practices that may undermine its negotiated nature and procedural celerity. The research employs a jurimetric and empirical methodology, examining agreements concluded at the Barra Funda Criminal Court to assess the degree of negotiation, the conditions established, and their impact on procedural duration. The findings indicate distortions in the agreement’s negotiated nature, revealing standardized proposals and limited victim participation. It is also observed that the isolated application of certain conditions is insufficient to fulfill the preventive and retributive purposes of the sanction. Despite these limitations, the ANPP demonstrates significant efficiency gains in criminal prosecution, contributing to the rationalization of the justice system. It is concluded that the effectiveness of the instrument depends on procedural improvements, the adequacy of conditions to each specific case, and the careful performance of the Public Prosecutor’s Office to ensure the legitimacy and original purpose of the agreement.
