Abstract

Abstract: Objectives: This article analyzes the exclusion of the Non-Prosecution Agreement (NPA) in cases of domestic violence in Brazil, seeking to understand its implications for the health and protection of victims. Methodology: This is a qualitative research based on a critical-narrative review of legal doctrine, legislation, and judicial decisions, using a dialectical approach with normative and documentary analysis. Results: The findings indicate that the exclusion of the NPA is related to the prioritization of victims and the accountability of aggressors, but empirical data suggest that negotiated criminal justice may serve as an effective alternative. The slowness of the judicial system increases the vulnerability of victims, while negotiated criminal justice may offer greater speed and comprehensive protection. Conclusions: The exclusion of the NPA reflects a focus on victim protection, but the delays in the system demand attention to mechanisms that ensure effective justice, with restorative practices that reduce recidivism and victim suffering, without compromising the punishment of aggressors.

  • Andressa Felix Lisboa, Universidade Santa Cecília

    Attorney-at-Law and Specialist in Social Security Law. Guest student in the "Theories of Law and Justice" course within the Postgraduate Program in Law at the Federal University of Bahia (PPGD/UFBA) for the 2025.2 academic semester. She holds a Master’s degree in Health Law from UNISANTA (CAPES Scholar), focusing her research on "State and Social Health Planning." Professor of Postgraduate studies in Labor and Social Security Law and lecturer for extension courses on social security at the Superior School of Law (ESA/SP). She serves as an evaluator for undergraduate theses at the University Santa Cecília and is an active member of the organizing committee for the International Health Law Congress - UNISANTA. Head of the Health Law department at Karina Pucci Law Firm. Previously served as an intern at the National Institute of Social Security (INSS).

  • Alexandre Rocha Almeida de Moraes, Universidade Santa Cecília

    Public Prosecutor at the State of São Paulo Public Prosecution Service. He holds a Master’s and a Doctorate in Law from the Pontifical Catholic University of São Paulo (PUC-SP). He is a Professor of Undergraduate and Postgraduate studies at PUC-SP and UNISANTA, as well as a Professor in the Master’s Program in Health Law at UNISANTA. He also teaches in several postgraduate courses, including the Superior School of the Public Prosecution Service of São Paulo and the São Paulo School of Judges (EPM). Author of several legal works, such as: Criminal Law: General Part (Fórum), Enemy Criminal Law and Rational Criminal Law (Juruá), and Criminology (Juspodivum).

  • Silvia Chakian de Toledo Santos, Pontifícia Universidade Católica de São Paulo

    Public Prosecutor at the State of São Paulo Public Prosecution Service (MPSP) since 1999. She holds a Bachelor of Laws (1997) and a Master of Laws (LL.M.) in Criminal Law (2019) from the Pontifical Catholic University of São Paulo (PUC-SP). She is a Specialist in Gender-Based Violence from the University of Rome Tor Vergata.

    Throughout her career, she coordinated the Special Action Group for Addressing Domestic and Family Violence against Women (GEVID) from 2012 to 2016. She was a member of the Permanent Commission for Combating Domestic and Family Violence (COPEVID) within the National Human Rights Group (GNDH/CNPG) from 2011 to 2022. She also served as a collaborating member of the National Council of the Public Prosecution Service (CNMP) (2015-2016) and as an advisor and member of the Board of the Superior School of the MPSP.

    Currently, she serves as the Coordinator of the Victims of Violence Assistance Center (NAV) and the Coordinator of the Women's Ombudsperson's Office, both within the MPSP. She is the author of The Construction of Women's Rights (Lumen Juris) and co-author of Crimes against Women and Crimes against Children and Adolescents (Juspodivm). She has extensive experience in criminal law and human rights, focusing on gender, domestic, and sexual violence.
