Evolution and Effectiveness of the Right to Health in Brazil
An Analysis in the Light of Human Rights and the Principle of Comprehensiveness

Contextualization: The right to health is one of the fundamental pillars of human rights, enshrined in the 1988 Federal Constitution and regulated by the Unified Health System (SUS). Problem: Despite its normative recognition, equitable and comprehensive access to health care in Brazil still faces structural, institutional, and cultural barriers. Objectives: To analyze how the historical evolution of human rights has contributed to the consolidation of the right to health, identifying obstacles to its effectiveness and highlighting the need for interdisciplinary and multisectoral approaches. Methods: A qualitative, exploratory study based on bibliographic review and documentary analysis of doctrinal works, scientific articles, and national and international regulations. Results: It was found that, although the right to health is constitutionally guaranteed, social and regional inequalities compromise the comprehensiveness of care, requiring more effective public policies, social participation, and greater cross-sectoral integration. Conclusions: Strengthening the right to health requires institutional improvement combined with ethical and political engagement from society, the State, and legal professionals, in order to ensure universal, equitable, and democratic health.
