Abstract

The role of the Judge in a democratic society has evolved alongside the democratic political system, generating new content. The modern Rule of Law is the constitutional State, where the judge plays a relevant role, interpreting the norm with discretion and independence, validating it constitutionally (constitutionality control), to provide reasonable, fair and effective solutions. And although in democracy the division of powers must be respected, in the face of repeated violations of fundamental rights, the Superior Courts have been allowed to dictate the so-called “structural sentences” through which a public policy is projected or the issuance of the same is encouraged or of a law that protects said rights violated with a collective projection.
