A nihilistic hermeneutics of Law?

Abstract

The article appears in the context of the emergence of integrating law into Postmodernity, leading it towards an ontology of decline. Hermeneutics, particularly Gianni Vattimo's Nihilist or Weak hermeneutics, plays a central role in the process of weakening the strong structures (pensiero debole) of law and the Judiciary, consolidating a path towards an approach that aims to reduce institutionalized legal violence. The main objective is to understand the Nihilist Hermeneutics of Law and how it can offer a less violent vector, exploring scenarios in which those silenced by a single form of existence to be realized can compose, through an ontology of the present, the meaning of the right for realization of justice.

Doctor and Master in State Law, in the sub-area of ​​Constitutional Law, from the Pontifical Catholic University of São Paulo-PUC/SP. Associate Professor of the Graduation in Law and the Master's Program in Law at the Federal University of Sergipe-UFS. Consultant to the FAPITEC/SE Advisory Chamber. Consultant for the Coordination for the Improvement of Higher Education Personnel - Capes. Member of the Board of Directors of the National Council for Research and Postgraduate Studies in Law – CONPEDI.
