Abstract

In this article, the author clarifies precisely how the genesis and process of internationalization of human rights gave rise to a new paradigm, which, based on “justicialization”, offers support to the historical needs and demands for justice of the new social actors. This transformation, along with others, has given rise to a profound reformulation of the principles and foundations of local constitutional rights, when included in the sphere of “International Human Rights Law”.
