Carl Schmitt’s essay Der Hüter der Verfassung (The Guardian of the Constitution) first appeared in March 1929 in the then respectable periodical Archiv des öffentlichen Rechts (No. XVI, pp. 161–237). In Volume 6 of Die Justiz, 1930–1931, pp. 576–628, Hans Kelsen responds to Carl Schmitt’s abovementioned essay on the guardian of the Constitution. The title of Kelsen’s essay is Wer soll der Hüter der Verfassung sein? (Who should be the guardian of the Constitution?). The present text examines Kelsen’s arguments.
